Surrogacy: Nightmare in the Netherlands

A birth with serious consequences, since due to this surrogacy carried out with an oocyte donation and through in vitro fertilization, the child therefore has a biological father, a “gestational” mother, a biological mother, and two “legal” fathers, so they can proceed with the adoption: a dizzying situation.

It is the reform of the bioethics law implemented in the Netherlands which, by modifying the legal provisions on embryos, opened the way for the practice of surrogacy for male couples, through a donation of sperm from one of them, and an egg donation from a woman separate from the surrogate mother.

But that's not all. In the land of tulips, commercial surrogacy is not illegal: it is only professional or commercial mediation between the surrogate mother and the couple who request surrogacy, which is currently prohibited - but for how long - by Dutch law.

Thus, if it is forbidden to publish an advertisement on social networks seeking to offer or request surrogacy services, it remains lawful to practice surrogacy in a clinic, with remuneration offered without intermediary to the woman who agrees to carry the child who does not come from her.

And to top it off, since the Netherlands does not automatically recognize the homosexual couple as legal parents of the child resulting from this surrogacy, they are required to follow an adoption procedure, implying that the mother formally gives up her rights to the child after birth.

This sad first will not fail to spread to France: the revision of the bioethics law passed by parliament in the heart of the summer of 2021, in allowing the genetic modification of a human being, the experimentation animal-human chimeras, the creation of artificial gametes or embryonic models, carries with it the principle of the ultimate transgression.
